RESOLUTION (96) 8

APPOINTMENT OF EIGHT MEMBERS OF THE HUMAN RIGHTS

CHAMBER FOR BOSNIA AND HERZEGOVINA

AND DESIGNATION OF ITS PRESIDENT

(Adopted by the Committee of Ministers on 12 March 1996

at the 560th meeting of the Ministers' Deputies)

    The Committee of Ministers, under the terms of the "Agreement on Human Rights" contained in Annex 6 to the General Framework Agreement for Peace in Bosnia and Herzegovina, initialled in Dayton, Ohio, and signed in Paris on 14 December 1995 (hereafter referred to as "the Peace Agreement"),

    Considering that pursuant to Article VII, paragraph 2, of Annex 6 to the Peace Agreement the Committee of Ministers is called upon to appoint eight members of the Human Rights Chamber for Bosnia and Herzegovina (hereafter referred to as "the Chamber") and to designate one such member as the President of the Chamber;

    Having regard to Resolution (93) 6 on the control of respect for human rights in European states not yet members of the Council of Europe adopted by the Committee of Ministers of the Council of Europe on 9 March 1993;

    Having examined the candidatures submitted in December 1995 and January 1996;

    Having drawn up, following elections by secret ballot, a list of eight members for the Chamber at the 557th meeting of the Deputies held from 5 to 8 February 1996;

    Having consulted the Parties (namely the Republic of Bosnia and Herzegovina, the Federation of Bosnia and Herzegovina and the Republika Srpska) on the above-mentioned list;

    Considering that Article VII, paragraph 3, of Annex 6 to the Peace Agreement provides that the members of the Chamber shall be appointed for a period of five years;

    Considering that Article VII, paragraph 2, of Annex 6 to the Peace Agreement provides that the Committee of Ministers shall designate one of the members it has appointed as President of the Chamber,

    Declares the following candidates appointed (in alphabetical order): Professor Rona Aybay (Turkey); Professor Peter Germer (Denmark); Professor Giovanni Grasso (Italy); Mr Jakob Th. Möller (Iceland); Professor Manfred Nowak (Austria); Judge Michèle Picard (France); Professor Dietrich Guido Rauschning (Germany); Professor Adam Zielinski (Poland), as members of the Human Rights Chamber for Bosnia and Herzegovina, with effect from 15 March 1996, for a term of office which will expire no later than 14 March 2001, and

    Designates Professor Peter Germer as President of the Human Rights Chamber for Bosnia and Herzegovina, with effect from 15 March 1996, for a term of office which will expire no later than 14 March 2001.
